To begin with, I’ll ask each party to tell me what issues they would like to discuss in mediation. Then the parties will have an opportunity to discuss each of those issues. I ask parties to be respectful and listen to what is being said and not interrupt. Each party will be able to express concerns, suggest options, and make decisions. If you reach an agreement, I will write a Memorandum of Understanding which outlines the agreements reached in mediation. You then have the option of taking the Memorandum to an attorney or using the OCAP (online court assistance program) to draw up the stipulated agreement which will be submitted to the court.
